FCC Adopts NPRM to Accelerate Wireless Infrastructure Buildout

The FCC has adopted a Notice of Proposed Rulemaking (NPRM) that aims to accelerate buildout of wireless infrastructure, including cell phone towers.  In the NPRM, the Commission will propose to update its rules to expedite the deployment, densification, and upgrading of wireless networks.  The NPRM will also clarify that state and local restrictions cannot unlawfully block 5G or, eventually, 6G deployment.  The Commission will seek comment on processes to expedite the resolution of permitting disputes, including possibly through a “rocket docket” process.  Additionally, the Commission will request comment on state and local limits on deployment of macro cell towers and other wireless facilities, imposition of unreasonable delays or fees, conditioning of approval on aesthetic or similar criteria, and other impediments to building.
