The Federal Communications Commission has adopted a Second Report and Order expanding the scope of communications equipment on the Covered List, a list maintained by the Commission that identifies communications equipment and services determined to pose an unacceptable risk to the national security of the U.S. Specifically, the item prohibits authorization of modular transmitters and devices containing them if produced by entities on the Covered List. The Second Report and Order also creates a process to block further importation and marketing of previously authorized covered equipment, while allowing continued use.
The accompanying Second Further Notice of Proposed Rulemaking seeks comment on defining “critical infrastructure” for purposes of the 2019 NDAA, evaluating component parts for security risks, and improving enforcement of marketing restrictions.
