The FCC has released a Public Notice reminding states that regulate pole attachments of their duty, pursuant to section 224 of the Communications Act, to issue and make effective rules and regulations implementing their authority over pole attachments. The FCC emphasized that these states must “actually” regulate the rates, terms, conditions, and procedures to resolve complaints regarding pole attachments. The Commission also seeks comment on the status of state pole attachment regulation to help guide it in making state reverse-preemption pole attachment regulations “more transparent and effective.” The FCC also requests comment on whether it has a statutory duty to review state pole attachment regulations in order to ensure that states comply with the Communications Act and the FCC’s rules. Comments are due July 13, 2026, and Reply Comments are due July 27, 2026.
