Comment Sought on PAL Aggregation Limit Waiver Request

The FCC’s Wireless Telecommunications Bureau (WTB) is seeking comment on a request for waiver filed by Citizens Band License Company, LLC (CBLC) and NE Colorado Cellular, Inc. dba Viaero Wireless (Viaero) (CBLC and Viaero together, Applicants) of section 96.31(a) of the FCC’s rules, which would allow Viaero to exceed the four Priority Access License (PAL) channel limit in seven counties.  Specifically, under the FCC’s rules, Priority Access Licensees are subject to an aggregation limit of up to four PALs in a county-based license area at any given time. 

Under the Applicants’ proposed assignment, CBLC would sell ten PALs to Viaero in seven counties in Colorado.  The Applicants state that the proposed assignment would result in Viaero holding six PAL channels in three Colorado counties (Huerfano, Prowers, and Saguache) and holding five PAL channels in four Colorado counties (Alamosa, Conejos, Lincoln, and Rio Grande).  Comments and petitions on the waiver request are due September 17, 2025
