The FCC’s Wireline Competition Bureau (WCB) has issued a Public Notice seeking comment on a petition for preemption and declaratory ruling filed by BIF IV Intrepid OpCo LLC, pursuant to Section 253 of the Communications Act. The petition requests the FCC to preempt a contract made between the city of Cottage Grove, Minnesota, and a provider to deploy fiber optic infrastructure in the city. The contract allegedly grants exclusive rights to the chosen broadband partner(s) to access the city’s rights of way for broadband services until at least 2030, which Intrepid claims has led to the denial of its permit applications to expand its fiber optic network in the city.
Interested parties are invited to submit comments or oppositions regarding the Intrepid Petition by September 12, 2025, and reply comments by October 14, 2025.
