Commerce Department Proposes Rules on Securing Technology Supply Chain

The U.S. Department of Commerce (DoC) has issued a Notice of Proposed Rulemaking (NPRM) requesting comment on the implementation of Executive Order 13873, entitled “Securing the Information and Communications Technology and Services (ICTS) Supply Chain,” which was issued by President Trump on May 15, 2019. Executive Order 13873, issued pursuant to the International Emergency Economic Powers Act and the National Emergencies Act, grants the DoC the authority to prohibit any acquisition, importation, transfer, installation, dealing in, or use of any information and communications technology or service subject to U.S. jurisdiction. The NPRM proposes to implement regulations that would govern the process and procedures that the Secretary of Commerce will use to identify, assess, and address certain information and communications technology and services transactions that pose an undue risk to critical infrastructure or the digital economy in the U.S., or an unacceptable risk to U.S. national security or the safety of U.S. citizens. The public has until December 27, 2019 to submit comments in this proceeding.
