The FCC has adopted a Further Notice of Proposed Rulemaking (FNPRM) to eliminate several broadband label rules that it adopted in 2022. In order to ensure that the Broadband Nutrition Label rules align with what Congress intended in the 2021 Infrastructure Investment and Jobs Act, the FCC specifically proposes to eliminate the requirements for providers to: (a) read the label to consumers over the phone (b) to itemize state and local passthrough fees, (c) provide information about the now-concluded Affordable Connectivity Program; (d) display labels in customer account portals; (e) make labels available in machine readable format; and (f) archive labels for at least two years after a service is no longer offered to new customers. In addition to seeking comment on the removal of these requirements, the FCC is seeking comment on any other broadband label requirements that are unduly burdensome for providers.
