FCC Grants AT&T Complaint Alleging Unlawful Tariffed Interstate Rates

The Federal Communications Commission (FCC) has granted, in part, a formal complaint filed by AT&T Services Inc. and AT&T Corp. (collectively, AT&T) against Great Lakes Comnet, Inc. (GLC). In the complaint, AT&T alleged that GLC charged AT&T unlawful tariffed rates for interstate access services. The FCC granted Count I and II of AT&T’s complaint, after finding that GLC violated the FCC’s rules governing competitive local exchange carrier tariffs for interstate access services, and that the tariff therefore is unlawful. Because AT&T bifurcated the liability and damages claims in its complaint, AT&T may pursue an award of damages to be determined in the next phase of the complaint proceeding.
