FCC Seeks Comment on Pole Attachment Petition

The FCC’s Wireline Competition Bureau is seeking comment on a petition for declaratory ruling filed by the Edison Electric Institute (EEI) on April 20, 2021.  EEI asks the FCC to declare that (1) when the Commission determines that a pole attachment rate, condition, or term is unjust and unreasonable and orders a refund pursuant to section 1.1407(a)(3) of the FCC rules, the applicable statute of limitations is the same as the two-year period prescribed by section 415(b) of the Communications Act; and (2) refunds in pole attachment complaint proceedings are inappropriate for the period preceding good-faith notice of a dispute.  Comments on the petition are due on August 23 and reply comments are due on September 7.
