In a joint status report filed in the U.S. District Court for the District of Columbia (District Court), the Department of Justice and National Digital Inclusion Alliance (NDIA) stated that the National Telecommunications and Information Administration is drafting a Notice of Funding Opportunity (NOFO) for the Digital Equity Act’s Competitive Grant Program with a goal of accepting applications in December. The NOFO will require several rounds of Executive Branch review. NDIA sued in 2025 over the White House’s elimination of the $2.5 billion grant program. In July, the District Court denied a motion to dismiss the legal challenge.
