The FCC has adopted a Notice of Proposed Rulemaking proposing rules to codify some of its existing practices related to the review of foreign ownership structures for Section 310(b) purposes.  In implementing Section 310(b) of the Communications Act, which imposes certain restrictions on who may hold various types of radio licenses and requires the FCC to review foreign investment in licensees, the Commission has adopted numerous policies that it has never codified in its rules.  The adopted NPRM seeks comment on, and proposes to, codifying its existing practice regarding the designation of a controlling U.S. parent, requiring identification of trusts and trustees, and extending the methodology for determining foreign ownership and remedial process to privately held companies, among other proposals.
