The Federal Communications Commission has adopted a Third Report and Order that prohibits authorization of devices containing a “smart” component, or logic bearing hardware components, that are produced by Covered List entities. The R&O also requires e-commerce platforms to list FCC IDs for FCC-certified devices.

The FCC has also adopted a Third Further Notice of Proposed Rulemaking (FCC 26-50) proposing to bifurcate the Covered List into producer/provider-based entries and production location-based entries and seeks comment. The FNPRM proposes to expand supply chain disclosures at the application stage and tightening rules for the self-attestation Supplier’s Declaration of Conformity process.
